Would a BJ team contract hold up in court?

A Nassau County judge this week threw out a case where four people had a written contract to share winnings from a SuperBowl pool on the grounds that Federal and State law makes it illegal to have a gambling contract.
I'd imagine this would include a contract involving distribution of a BJ teams winnings.
Is anyone aware of a court case that involved a BJ team?

It's not at all illegal to have a gambling contract. A contract based on ILLEGAL activities is unenforceable, which was the case in that lawsuit. Gambling between private parties is illegal in the state of New York.

Courts have ruled over & over that gambling debts to a LEGAL casino ARE legal and collectable, even across state lines; even if the defendant is a resident of a state where gambling is illegal. A gambling debt IS a gambling contract.

I have PERSONALLY been involved in a lawsuit, filed in the state of Texas, where we actually had to file suit against a BP who refused to pay up after a large Vegas win. His defense was exactly THAT; that our contract was illegal and he wasn't obligated to honor it. After the judge ruled in our favor on that particular point, he decided to pay up to avoid going to trial. BTW; it was only a VERBAL contract, we had nothing written down. The judge STILL ruled that it was legal and binding.

Yes to put it more clearly if you and I have a contract to rob a bank the contract is not valid because it involve engaging in an illegal activity.

I think that we all know what the answer SHOULD be. But that doesn't help you with the risk that the judge will be an idiot, and give you a bad decision. The risk of being the victim of prejudice against gambling is pretty high.

Even in more ordinary circumstances, my advice to people is that if you have to go to court to collect a debt, it's about 80% gone, statistically speaking. There are so many things that can go wrong. Whatever line of business you're engaging in, you don't want to have to rely on the courts to protect you. Deal with people that you know you can trust. Don't get overextended in giving credit.
